1. CONCLUSION OF THE RENTAL AGREEMENT

(1) Bookings can be made through our website (https://9a316956.smoobu.net/de/) / Airbnb / Booking / Fewo-direkt. Providing personal data and accepting the terms and conditions on the website constitutes a legally binding contract.

(2) Bookings made via other methods (email, phone, in person) become legally effective upon receiving an initial payment within 6 days of receiving the rental contract. Failure to make this payment within the specified period will result in booking cancellation.

(3) Previous reservations, provisional offers, and options require a guest's written confirmation via email, post, or phone within the specified reservation period to become a binding booking. Failure to respond will result in the vacation property being made available again. A confirmed booking will result in a legally binding rental agreement.

(4) The availability of vacation apartments is updated multiple times daily. Double bookings will be addressed with the guest; otherwise, bookings are considered valid.

(5) There is a minimum stay requirement for the vacation apartments, but this can be adjusted upon request. Contact us for more information on adjusting the duration of your stay.


2. RENTAL AGREEMENT CONDITIONS

(1) The rental agreement obligates both parties to fulfill the contract. The agreed-upon rental period is binding; late arrival or early departure will not be refunded.

(2) The owner can terminate the rental agreement due to force majeure or reasons beyond their control up to one month before the rental start date. The owner will refund any amounts paid, and alternative accommodation will be sought.

(3) If the rented vacation property matches the description and the guest is dissatisfied, no alternative property will be offered, and cancellation is not possible.

(4) The rental agreement covers the described vacation property, which comes fully furnished. Bed linens, towels, cribs, and highchairs are provided only if included in the listing. Optional services like cleaning fees are mandatory and cannot be waived.

(5) The vacation property must only be occupied by the maximum number of persons stated in the description, including infants and children. Access to the property is restricted to the number of booked guests.

(6) Pets are only allowed in designated properties after a contract amendment. Non-smoking properties must be respected. Violations will result in cleaning and damage costs.

(7) Guests must use allocated parking spaces if provided.

(8) Guests using provided internet access must adhere to regulations, including no illegal content, copyright infringement, and spam.


3. PAYMENT

(1) In order to make your stay as smooth as possible, we require full payment immediately upon booking.The total payment is due within 6 days after booking.

For bookings with less than 7 days' notice, cash payment or PayPal is required upon your arrival.

Key handover will only take place upon receipt of the full payment.

(2) We recommend purchasing travel insurance.


4. CANCELLATION

(1) If you are unable to commence your trip, you must promptly inform us in writing. We will make every effort to rebook the rental property; however, we are not obligated to do so.

(2) Cancellation fees for holiday homes, apartments, and lodgings are as follows (percentage of the contract price):


Cancellation Fees:

0% up to 21 days before your arrival.
50% up to 14 days before your arrival.

80% up to 5 days before your arrival.

100% within 5 days before your arrival or in case of a no-show.


(3) Additionally, a cancellation processing fee of €35 will be charged in all cases. The actual cancellation costs will be communicated to you after the canceled booking period. Therefore, we recommend purchasing travel insurance.

(4) Changes to the booking dates may be made, subject to availability, only with written notice no later than 5 days before your arrival, provided the amount remains the same or is higher. We will do our best to accommodate your request, but we are not obligated to do so.


5. ARRIVAL

(1) The property is available to guests from 3:00 PM on the arrival day.

(2) Key handover occurs in person or via a key safe with detailed instructions provided on the check-in day. Please note the exact instructions and adhere to the agreed-upon times for key handover to ensure a smooth check-in.


6. DEPARTURE

(1) Guests must vacate the property by 10:00 AM on the departure day. Keys must be returned to the designated location to facilitate cleaning for the next guests.

(2) Outside of regular hours, guests may use the key safe for key return. No keys should be left inside the property.

(3) Guests are responsible for cleaning and any damages caused during their stay. Notify us of any issues upon arrival to address them promptly.


7. FINAL PROVISIONS

(1) Data storage: Personal data is stored and processed in accordance with applicable data protection laws.

(2) All agreements must be in writing.

(3) Jurisdiction is the competent local court of Birkenfeld, regardless of the dispute value.


8. House Rules

(1) Guests must adhere to house rules during their stay and use offered services.

(2) House rules govern guest behavior within the premises and facilities provided by the company.

(3) Guests must follow instructions from company personnel regarding house rules.

(4) The company reserves the right to exclude guests who violate house rules from further service.

(5) Guests are liable for damages resulting from violations of house rules.
